Effective Date: September 6, 2026 · Last Updated: October 18, 2026
PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER (SECTION 17), A ONE-YEAR LIMITATION ON CLAIMS (SECTION 15.4), AND LIMITATIONS ON OUR LIABILITY (SECTION 15). BY PLACING AN ORDER OR APPROVING A PROOF, YOU AGREE TO BE BOUND BY THESE TERMS.
These Terms of Service ("Terms") are a legally binding agreement between you and Inland Engravings ("Inland Engravings," "we," "us," or "our") governing your access to and use of inlandengravings.com (the "Site"), your account, and any quotes, proofs, products, and services we provide (collectively, the "Services"). Our Privacy Policy, Refund & Return Policy, and Shipping Policy are incorporated into these Terms by reference and together form the entire agreement between you and us.
1.1 How you accept these Terms. You accept these Terms, and they become binding on you, when you do any of the following: (a) check the box or click a button indicating agreement at checkout, account creation, or quote request; (b) approve a digital proof, including by replying "approved"; (c) submit payment or a deposit; (d) issue a purchase order; or (e) otherwise use the Services. Each of these actions is an electronic signature under the federal E-SIGN Act and the California Uniform Electronic Transactions Act, and each has the same legal effect as a handwritten signature.
1.2 Our records are the record. You agree that our electronic records of your account activity, orders, proof approvals, communications, and payments, kept in the ordinary course of business, are accurate and admissible evidence of the transactions and agreements between us.
1.3 Eligibility. You must be at least 18 years old and legally able to enter into a contract. If you use the Services on behalf of a business, organization, or government entity, you represent that you have authority to bind that entity, these Terms bind that entity, and "you" includes the entity.
1.4 Changes. We may revise these Terms at any time by posting the updated version on the Site with a new "Last Updated" date. The version in effect when you approve a proof or place an order governs that order. Continued use of the Services after a change is acceptance of the change.
2.1 Registration. To place orders and track them you may create an account with your name, email address, phone number, and password. You must provide accurate information and keep it current. You may not create an account for anyone other than yourself or an entity you are authorized to represent.
2.2 Security. You are solely responsible for safeguarding your login credentials and for all activity under your account, whether or not authorized. Orders, approvals, and communications sent from your account, or from the email address or phone number on your account, quote request, or order, are deemed authorized by you. Notify us immediately at info@inlandengravings.com of any unauthorized use. We are not liable for losses arising from your failure to protect your credentials.
2.3 Suspension and termination. We may suspend or close your account, refuse service, or cancel orders at any time for violation of these Terms, suspected fraud, abusive conduct toward our staff, repeated unfounded claims or chargebacks, or any other lawful reason. Termination does not relieve you of payment obligations for orders already placed.
3.1 Quotes. Quotes are estimates based on the information you provide and are valid for 30 days unless otherwise stated. Quotes change if specifications, quantities, materials, artwork, or delivery requirements change. Verbal quotes are not binding.
3.2 Your order is an offer. Your order, purchase order, or quote acceptance is an offer to purchase. A contract is formed only when we (a) send an order confirmation, (b) receive your proof approval and payment or deposit, or (c) begin production, whichever occurs first. We may decline any order for any lawful reason, including pricing or product errors, material unavailability, suspected fraud, or content that violates Section 7. If we decline an order you have paid for, our sole obligation is to refund the amount paid.
3.3 Purchase orders. If you issue a purchase order, these Terms govern. Any pre-printed, conflicting, or additional terms on your purchase order, vendor forms, or portal are rejected and have no effect unless we expressly accept them in a document signed by us.
3.4 Pricing errors. If a product is listed at an incorrect price due to a typographical, system, or data error, we may cancel the order and refund you, or contact you to confirm the corrected price before proceeding.
3.5 Quantity tolerances. "Pack items" are products sold by the pack or with a minimum order quantity, such as pins, lanyards, challenge coins, and similar promotional items, including direct-ship items (see our Shipping Policy). Consistent with promotional-products industry standards, pack items may be shipped and invoiced with an overrun or underrun of up to 5% of the ordered quantity, and you are billed for the quantity that ships. An overrun or underrun of 5% or less is not a breach, and an underrun does not entitle you to a refund beyond the per-unit price of the units not shipped. If you require an exact quantity on a pack item, request it in writing before proof approval; a surcharge may apply. Everything else is made in the exact count you order.
3.6 Substitutions. If a specified product, material, or color becomes unavailable, we may offer a substitute of equal or better quality and value. We will obtain your approval before substituting on any order that has not yet entered production.
4.1 Proof required. For custom orders we provide a free digital proof, normally within 48 hours of receiving complete artwork and order details. Proof timing is an estimate. Production does not begin until we receive your written proof approval, such as a reply of "approved" by email or text message, or approval through an account portal or other written means.
4.2 Proof approval is final. By approving a proof you represent that you have reviewed it in full and you accept, without limitation, all spelling, grammar, punctuation, names, dates, numbers, text, artwork, logo placement, size, orientation, font, layout, product, material, color, size, and quantity shown. Once approved, the proof is the specification for your order. Our responsibility is to produce exactly what you approved, within the tolerances in Sections 3.5 and 4.4. You, not we, are responsible for any error, omission, or design choice that appears in an approved proof, and any correction after approval is a new order at your expense.
4.3 Artwork quality. If you supply low-resolution, non-vector, or otherwise deficient artwork, we will do our best to prepare it for production and the proof will reflect the result. By approving the proof, you accept the artwork quality shown. We are not responsible for pixelation, blurriness, or loss of detail that is visible in the approved proof.
4.4 Screen and material variance. Digital proofs are displayed on screens and cannot exactly represent engraved, printed, embroidered, or sublimated results. Engraving depth and contrast vary by material and natural grain; wood, leather, stone, cork, and anodized metal contain natural variation; printed, sublimated, and embroidered colors may differ from on-screen colors and between production runs. 3D-printed items show layer lines, small marks where supports were removed, and minor size differences. Placement and size may vary within industry tolerances (generally 1/4 inch or 5%). These variations are not defects. If exact color matching is critical, request a paid pre-production sample before approving the full run; if you decline a sample, you accept the risk of variation.
4.5 Revisions. Up to two rounds of proof revisions are included. Additional revisions, complex artwork recreation, and design services beyond proofing may be billed at our current design rate, which we will disclose before performing the work.
4.6 Turnaround starts at approval. All production and delivery timelines begin when we receive proof approval and payment (or the required deposit), not when the order is placed. Delays in approval, artwork, or payment extend the timeline day for day.
4.7 Verbal approvals. We do not accept verbal proof approvals. If you approve by phone, we will send a written confirmation and production begins only upon your written reply.
5.1 Estimates only. Production times are estimates based on current workload and material availability. Most orders are ready within 3 to 5 business days after proof approval; pack items, larger orders, embroidery, and direct-ship items may take longer. Your quote states an estimated date; an estimated date is not a guaranteed in-hands date. Time is not of the essence for any order unless we have expressly agreed to a guaranteed in-hands date in writing on the quote or order confirmation.
5.2 In-hands dates. A required delivery date is binding on us only when it appears in writing on your quote or order confirmation, labeled as a guaranteed in-hands date, with our acknowledgment. Dates mentioned in order notes, texts, calls, or emails without our written confirmation are requests, not commitments. If we miss a guaranteed in-hands date due solely to our production error, our sole liability is to refund any rush production fee you paid. We are not liable for any other loss arising from a missed date.
5.3 Rush production. Rush production applies only when we agree to it in writing on your quote or invoice. Rush production shortens our production time only; it does not affect carrier transit time and is subject to material availability and prompt approval. Rush fees are non-refundable except as stated in Section 5.2.
5.4 Shipping and risk of loss. Shipping is governed by our Shipping Policy. Title and risk of loss pass to you when we deliver the product to the carrier (or, for direct-ship items, when the item is handed to the carrier where it ships from) or make it available for pickup. Carrier tracking that shows "delivered" is conclusive evidence of delivery. We are not liable for carrier delay, loss, theft after delivery, or damage in transit, except that we will assist you in filing a carrier claim as described in the Shipping Policy.
5.5 Inspection and acceptance. You must inspect products within 7 days of delivery or pickup and notify us in writing of any claimed defect or nonconformity, with photographs and quantities affected. Failure to give written notice within 7 days constitutes irrevocable acceptance of the products and waives any claim for defects or nonconformity that inspection would have revealed.
5.6 Local pickup and unclaimed orders. Orders not picked up within 30 days of our ready notice, and shipments returned to us as refused or undeliverable, are deemed delivered and accepted. We may charge storage fees of $5 per day after 30 days and may dispose of unclaimed orders after 60 days without refund.
6.1 Payment due. Ready-made items bought at checkout are paid in full at checkout. For quoted work, we send a secure invoice after you approve your proof, and payment in full is due before production starts, unless your quote or invoice calls for a deposit or we have agreed in writing to net terms. We accept card and Shop Pay through our secure invoice, Zelle, and checks. We may hold production or shipment until payment clears, and a check may delay production until it clears. If a payment is declined, reversed, or returned, we may stop work and hold your order until it is paid in full. Prices exclude sales tax, shipping, rush fees, and design fees unless stated. Setup charges, when they apply, are shown on your quote before you approve.
6.2 Deposits. Where a deposit is required, production begins after we receive the deposit and your proof approval. Deposits are non-refundable once design work, proofing, or material ordering has begun (see our Refund & Return Policy, Sections 3 and 9). The balance is due before shipment or pickup, and we may retain products until paid in full.
6.3 Net-terms business accounts. Net terms are extended at our sole discretion and may be withdrawn at any time. Invoices are due within the stated period. Overdue balances accrue a late charge of 1.5% per month (18% per year) or the maximum rate permitted by law, whichever is less. We may suspend all production, shipment, and account access until the account is current. You agree to pay all costs of collection, including collection-agency fees, court costs, and reasonable attorneys' fees. The individual who applies for or uses net terms on behalf of a business personally and unconditionally guarantees payment of that business's obligations to us.
6.4 Security interest. Until paid in full, we retain title to and a purchase-money security interest in all products delivered to you, and you authorize us to file any financing statement necessary to perfect it.
6.5 Taxes. We collect California sales tax and other applicable taxes based on the shipping address. Tax-exempt customers must provide a valid resale or exemption certificate before the order is placed; we cannot refund tax after an order is invoiced.
6.6 Chargebacks and disputes. You agree to contact us before initiating a payment dispute. If you initiate a chargeback for an order that was produced according to an approved proof and delivered, made available for pickup, or shipped to the address you provided, you agree that the chargeback is improper. We will contest it with your proof approval, production records, and delivery confirmation, and you agree to reimburse us for the disputed amount plus any chargeback fees, collection costs, and attorneys' fees. We may refuse future service to customers who file improper chargebacks.
7.1 Your content. You retain ownership of logos, images, text, design files, 3D model files, and other materials you provide ("Customer Content"). You grant us a non-exclusive, worldwide, royalty-free license to reproduce, modify for production (including vectorizing, resizing, and color-separating), store, and use Customer Content to produce your order, provide the Services, and maintain records.
7.2 Your warranties. You represent and warrant that: (a) you own or have all rights, licenses, consents, and permissions necessary to use Customer Content and to have it reproduced on the products ordered; (b) Customer Content does not infringe or violate any trademark, copyright, trade dress, right of publicity, privacy right, or other right of any person; and (c) Customer Content is not unlawful, defamatory, obscene, or otherwise objectionable. This applies to logos and marks of schools, universities, sports teams and leagues, military units and branches, government agencies, corporations, franchises, and licensed characters. We are not a licensee of any such organization. We may require written proof of authorization and may refuse or cancel any order where rights are unclear, without liability to you.
7.3 Right to refuse. We may refuse any order containing content that we determine, in our sole discretion, is infringing, hateful, harassing, threatening, obscene, defamatory, promotes illegal activity, or that we otherwise decline to produce. We are not obligated to explain a refusal. Refunds for refused orders are limited to amounts paid for work not performed.
7.4 Our work product. Designs, layouts, mockups, proofs, vector files, templates, and other materials we create ("Work Product") are our property and protected by copyright. Upon payment in full, you receive a non-exclusive license to use the final design as applied to the products you purchased. Source files, editable files, and vector artwork are not included in a product purchase unless expressly stated in your quote and separately paid for. We may reuse general design elements, templates, and techniques. For design projects (such as logos, graphics, or marketing files), the scope, deposit, and the rights you receive in the final files are those stated in your design quote; this Section applies to anything the quote does not cover.
7.5 Portfolio and marketing use. Unless you notify us in writing before production, you grant us permission to photograph finished products and display them on our Site, social media, portfolio, and marketing materials, and to identify you or your organization as a customer. We will not disclose your pricing, order quantities, or information you identify as confidential in writing. To opt out, tell us in writing before production begins.
7.6 Retention of artwork. We may retain your artwork and proofs to facilitate reorders and as records, but we have no obligation to store them. You are responsible for keeping your own copies.
7.7 Site content. All content on the Site, including text, graphics, logos, photographs, product images, and software, is owned by us or our licensors. You may not copy, scrape, frame, or use Site content for any commercial purpose without our written permission.
If you supply your own items for engraving, printing, embroidery, or other decoration:
9.1 Intended use. Our products are decorative and promotional unless a product page or quote expressly states otherwise. You are responsible for determining that a product is suitable for your intended use. 3D-printed items are not rated for load-bearing, safety-critical, high-heat, outdoor, or food-contact use unless your written quote says so. If you supply a design or 3D model file, you are responsible for its dimensions, fit, and function; we produce it as shown in your approved proof. You are responsible for safely mounting or installing signs and other products, and for any permit or approval (for example from a city, landlord, or HOA) that a sign needs, unless installation is included in your written quote.
9.2 Regulatory compliance is your responsibility. Unless we expressly state otherwise in writing, we do not test, certify, or warrant products for compliance with any regulation governing your end use, including but not limited to children's product regulations (CPSIA), food-contact or FDA requirements, California Proposition 65, ANSI/ISEA high-visibility standards, flammability standards, or medical, electrical, or safety-critical applications. Decoration may affect a product's original certification (for example, printing or embroidery on high-visibility safety apparel may alter its ANSI classification). You are responsible for confirming compliance for your use and for any required labeling or warnings to your own customers or recipients.
9.3 Blank products and direct-ship items. Blank products we decorate, and products that ship directly from the facility where they are produced, are subject to the manufacturer's specifications, availability, and any manufacturer warranty, which we pass through to you to the extent transferable. We make no independent warranty regarding these products beyond the decoration matching the approved proof.
9.4 Resale. If you resell our products, you are solely responsible for compliance with all laws applicable to your sales and for your obligations to your customers.
10.1 Reseller and white-label orders. We may ship blind (without our branding) on request. You are responsible for your customers' claims and satisfaction.
10.2 Government orders. For federal, state, or local government purchasers, applicable procurement regulations govern to the extent they conflict with these Terms; all other provisions apply.
10.3 Recipient information. If you provide names and addresses of employees, members, or recipients for direct shipment, you represent that you have the right to share that information with us and that we may use it to fulfill the order.
You agree not to: use the Services unlawfully or in violation of these Terms; attempt unauthorized access to the Site, other accounts, or our systems; use bots, scrapers, or automated tools to access the Site or collect content or pricing; interfere with the Site's operation or security; upload malicious code; impersonate any person or misrepresent your affiliation; harass, threaten, or abuse our staff; submit reviews or content that are false, misleading, or not based on your own experience; or make repeated claims, disputes, or chargebacks that we determine to be unfounded.
If you submit reviews, testimonials, photos, or other content to the Site, our social media, or third-party review platforms about us, you grant us a non-exclusive, perpetual, royalty-free license to use, reproduce, and display that content in connection with our business. You represent that submissions are truthful and your own. Nothing in these Terms restricts your right to post honest reviews of your experience. We may respond publicly to reviews with factual information about the order, including proof-approval and delivery records, to the extent permitted by law.
If you opt in to text messages, you consent to receive recurring automated marketing and informational messages from Inland Engravings at the number provided. Consent is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to cancel and HELP for help. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy.
EXCEPT FOR THE LIMITED REMEDY IN SECTION 15.1 AND OUR REFUND & RETURN POLICY, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT PRODUCTS WILL MEET YOUR REQUIREMENTS BEYOND CONFORMING TO THE APPROVED PROOF WITHIN THE TOLERANCES DESCRIBED IN THESE TERMS.
Some jurisdictions do not allow exclusion of implied warranties; to the extent an implied warranty cannot be disclaimed, its duration is limited to 60 days from delivery, or the shortest period the law allows if that is longer, and your remedy is limited to Section 15.1.
15.1 Exclusive remedy. If a product is defective in materials or workmanship or does not conform to the approved proof, and you give timely notice under Section 5.5, your sole and exclusive remedy is, at our option, remake, repair, or refund of the purchase price of the affected units only. We may require return of the affected units before providing the remedy.
15.2 Exclusion of damages. TO THE FULLEST EXTENT PERMITTED BY LAW, INLAND ENGRAVINGS AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST SALES, LOST GOODWILL, LOST BUSINESS OPPORTUNITY, COSTS OF SUBSTITUTE GOODS, EVENT CANCELLATION OR RESCHEDULING COSTS, OR DAMAGES ARISING FROM MISSED DEADLINES OR EVENTS, ARISING OUT OF OR RELATED TO THE SERVICES, THE PRODUCTS, OR THESE TERMS, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
15.3 Cap. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO AN ORDER, THE PRODUCTS, THE SERVICES, OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.
15.4 Time limit on claims. Any claim arising out of or related to the Services, the products, or these Terms must be brought within one (1) year after the claim accrues, regardless of any longer statutory limitations period, or it is permanently barred.
15.5 Application. These limitations apply regardless of the legal theory (contract, warranty, tort, negligence, strict liability, or otherwise), apply even if a limited remedy fails of its essential purpose, and are an essential basis of the bargain between you and us. Some jurisdictions do not allow certain limitations, so some may not apply to you; in that event our liability is limited to the fullest extent permitted by law.
You agree to defend, indemnify, and hold harmless Inland Engravings and its owners, employees, contractors, and suppliers from and against all claims, demands, liabilities, damages, losses, fines, penalties, costs, and expenses (including reasonable attorneys' fees and costs) arising out of or related to: (a) Customer Content, including any claim of infringement, misappropriation, or violation of rights; (b) your use of the Services or products, or your customers' or recipients' use of products; (c) your breach of these Terms or any representation or warranty; (d) your violation of any law or third-party right; (e) products you resell, distribute, or give to others; (f) any regulatory non-compliance of products for your intended end use; and (g) any improper chargeback or payment dispute. We may assume the defense of any matter subject to indemnification at your expense, and you will cooperate with us.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.
17.1 Informal resolution first. Before filing any claim, you agree to send a written notice of dispute to info@inlandengravings.com describing the issue, your order number, and the relief you seek, and to negotiate in good faith with us for 30 days. Most concerns are resolved this way. A demand for arbitration or a court filing made before completing this step is premature and may be dismissed.
17.2 Binding individual arbitration. If the dispute is not resolved informally, you and Inland Engravings agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, the products, or the relationship between us, including the validity, scope, or enforceability of this Section (a "Dispute"), will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (or Commercial Rules for business customers), available at www.adr.org. The Federal Arbitration Act governs this Section. The arbitrator, not a court, decides all threshold questions, including arbitrability. Arbitration will be held in Riverside County, California; for claims under $25,000 you may elect video conference or written submissions. The arbitrator may award the same individual relief a court could, but only to you individually. Arbitration fees are allocated under AAA rules; if AAA rules require us to pay fees that would otherwise be yours, we will do so. Judgment on the award may be entered in any court of competent jurisdiction.
17.3 Exceptions. Either party may bring an individual claim in small claims court in Riverside County, California, if the claim qualifies. Either party may seek injunctive relief in court to protect intellectual property rights or to enforce Section 6. Nothing in this Section prevents you from seeking public injunctive relief as permitted by California law or from filing a complaint with a government agency.
17.4 Class action and representative waiver. YOU AND INLAND ENGRAVINGS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court, not in arbitration, and will be stayed pending arbitration of all other claims.
17.5 Mass arbitration. If 25 or more similar arbitration demands are filed against us by the same or coordinated counsel, the parties agree that the demands will be resolved in batches of 25 under AAA's mass arbitration procedures, with a single arbitrator per batch, and filing fees will be paid only for demands actually proceeding in each batch.
17.6 Opt-out. You may opt out of this arbitration agreement by emailing info@inlandengravings.com with your name, address, order number (if any), and a clear statement that you wish to opt out of arbitration, within 30 days of first accepting these Terms. Opting out does not affect any other provision.
17.7 Jury trial waiver. To the fullest extent permitted by applicable law, for any Dispute that proceeds in court rather than arbitration, you and Inland Engravings each waive the right to a jury trial.
17.8 Survival and severability. This Section survives termination of these Terms. If any part of this Section other than Section 17.4 is found unenforceable, the remainder will be enforced.
18.1 Governing law. These Terms and all Disputes are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law rules.
18.2 Venue. Subject to Section 17, the state and federal courts located in Riverside County, California have exclusive jurisdiction over any court proceeding, and you consent to personal jurisdiction and venue there and waive any objection based on inconvenient forum.
18.3 Attorneys' fees. In any action or arbitration to enforce or interpret these Terms or to collect amounts owed, the prevailing party is entitled to recover its reasonable attorneys' fees, expert fees, and costs in addition to any other relief.
19.1 Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control, including natural disasters, fire, flood, earthquake, epidemic or pandemic, power or internet outages, equipment or software failure, delays or failures of carriers or of anyone who provides materials, products, or services to us, material shortages, labor disputes, government action, or civil unrest. Timelines extend for the duration of the event, and we may cancel affected orders and refund amounts paid for work not performed.
19.2 Entire agreement. These Terms, together with our Privacy Policy, Refund & Return Policy, Shipping Policy, and the written quote or order confirmation for your order, constitute the entire agreement between you and us regarding the Services and supersede all prior or contemporaneous agreements, proposals, and communications, written or oral. In the event of conflict, a written agreement signed by us controls, then these Terms, then the quote or order confirmation.
19.3 Severability and reformation. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and reformed to reflect the parties' intent, and the remaining provisions remain in full force.
19.4 No waiver. Our failure or delay in enforcing any provision is not a waiver of that provision or any other. Any waiver must be in writing and signed by us.
19.5 Assignment. You may not assign or transfer these Terms or any order without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
19.6 Notices. We may give you notice by email to the address on your account, by text to the number on your account, or by posting on the Site. Notices to us must be in writing, sent by email to info@inlandengravings.com. Email notice to us is effective when we acknowledge receipt. If you do not receive our acknowledgment within 2 business days, call us at (909) 265-3656 so we can confirm we received it.
19.7 Independent contractor. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship. We are an independent contractor.
19.8 Survival. Sections 1.2, 4, 5.4–5.6, 6, 7, 8, 9, 12, 14, 15, 16, 17, 18, and 19 survive completion of any order, termination of your account, or termination of these Terms.
19.9 Accessibility. We are committed to making the Site accessible to people with disabilities. If you have difficulty using any part of the Site, contact us at info@inlandengravings.com and we will assist you and work to remedy the issue.
19.10 Headings and interpretation. Headings are for convenience only. "Including" means "including without limitation." These Terms will not be construed against either party as the drafter.
